PRIVACY POLICY

LogicValley, the brand, is owned, managed and operated by LogicValley Technologies Private Limited (“LogicValley,” “we,” “us,” “our”), a company having its registered office at 2nd & 3rd Floor, Vijay Towers, 22, Father Randy St, R S Puram West, Coimbatore, Tamil Nadu 641002 and Corporate Identification Number as U72900TZ2017PTC029424. We provide state-of-the-art mobile field force solutions which enable our clients to optimize their business processes and reduce costs (“Services”). We respect every individual’s right to privacy and it is our endeavour to protect their personal and sensitive personal data or information (defined in clause 1). Prior to sharing your data with us, please read and understand this Policy carefully.

This Privacy Policy (“Policy”) applies to: (i) our existing and prospective clients/customers who use our website https://logicvalley.in/ (“Website”), mobile applications and/or any other product or service through which we may render services presently or in future (collectively referred to as “Service Platforms”); and (ii) persons who visit our Website (existing and prospective clients/customers mentioned at (i) and Website users mentioned at (ii) collectively referred to as “Users,” “you,” “your”).

The purpose of this Policy is to make Users aware about the collection, use, storage, disclosure and handling of their personal and sensitive personal data or information by us. The access and use of our Service Platforms is open only to Users who are 18 years or above. LogicValley does not target its products and services towards or intends to collect information from any individual who is below the age of 18. In the event the User provides false information about the age, we shall not be responsible for any loss or damage caused by such misrepresentation.

The access, browsing and continuous use of the Service Platforms constitutes a User’s unconditional consent and acceptance of this Policy. If at any time a User does not agree with any of the provisions of this Policy, he/she should immediately discontinue the use of our Service Platforms.

This Policy is published in compliance of:

  • Section 43A of the Information Technology Act, 2000 (“Act”)
  • Rule 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (“SPDI Rules”)
  • General Data Protection Regulation 2016 (GDPR) for data protection and privacy in the European Union and the European Economic Area.
1. Definitions

1.1 Personal information

Rule 2(1)(i) of the SPDI Rules defines personal information as any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person. For example, an individual’s name, age, date of birth, e-mail address, phone number can be categorised as personal information.

1.2 Sensitive personal data or information

Rule 3 of the SPDI Rules defines sensitive personal data or information as such personal information which consists of information relating to:

  • Password
  • Financial information such as bank account or credit card or debit card or other payment instrument details
  • Physical, physiological and other mental health condition;
  • Sexual orientation
  • Medical records and history
  • Biometric information;
  • Any detail relating to the above clauses as provided to body corporate for providing service
  • Any of the information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise

Any information which is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as sensitive personal data or information.

Hereinafter, any reference to the term “Information” includes personal and sensitive personal data or information, unless stated otherwise.

2. Types of Information we collect

2.1 When a User visits, accesses, browses and/or uses our Service Platforms, we may collect its personal information. This may include:

  • Full Name
  • e-Mail Address
  • Contact Number
  • Internet protocol (IP) address, browser type and version
  • Date and time of visit, pages accessed on our Website, time spent on those pages
  • Any other information that your browser sends us when you visit our Website
  • Any information relevant for data analytics or statistical purpose
  • Any other information relevant and necessary for accessing and using our Website

2.2 In addition to the personal information, we may also collect a User’s sensitive personal data or information whenever deemed appropriate and necessary for providing our products and services. The collection, use, disclosure and processing of your sensitive personal data or information shall be strictly regulated in accordance with the SPDI Rules.

3. Purpose of collection

LogicValley collects and uses Information only for specific, clear and lawful purposes. These include:

  • To administer and expand of the scope of our business activities
  • To respond to queries regarding our products and services
  • To give the User a personalised experience while using the Service Platforms
  • To improve customer support service
  • To improve existing products and services
  • To create new products and services
  • To detect, prevent and address technical issues
  • To detect, prevent and protect ourselves from potential frauds and illegal activities
  • To send promotional e-mails containing details about our existing and new products and services, newsletters, notify changes in this Policy or other policies and practices
  • To analyse the traffic on our Website and conduct market research
  • To respond to authorities requiring us to supply your Information pursuant to a legal obligation
4. Collection and Disclosure of Information

4.1 By virtue of visiting, browsing, accessing and/or using our Service Platforms, the User agrees to the collection, use, storage, possession, receiving, dealing or handling of the User’s personal information.

4.2 Any sensitive personal data or information shall be collected, used, stored, processed and disclosed in accordance with SPDI Rules and consent shall be deemed to be given by having confirmed to have read this Policy.

4.3 We may collect your Information through various means including but not limited to:

  • Visit, Access, Browsing and/or use of the Service Platforms
  • “Contact Us” and Enquiry Forms
  • Form Requesting Demo
  • e-Mail or any other means electronic correspondence
  • Telephone
  • Direct Contact
  • Information shared voluntarily by the User on our Service Platforms and customer support service
  • Information available on social media networking sites (if User chooses to access our Service Platforms through any of integrated networking sites)
  • Information collected by analysing online behaviour (through cookies)
  • Information required to be collected in accordance with applicable law (defined in clause 13)

4.4 All Information shall be collected only for the purposes outlined in this Policy and necessary for fulfilment of those purposes.

4.5 You have the options to (i) not share your Information and (ii) withdraw an earlier consent to collect, store or disclose your Information. If you exercise the first option, you may not be able to avail any features or services available on our Service Platforms. Where you exercise the second option, and the consent is withdrawn in accordance with the SPDI Rules, your data may not be deleted entirely and we reserve the right to limit access to the various features and services provided by us on the Service Platforms. However, this Information will be kept securely with us as per our security practices (defined in clause 5)

4.6 We may share the User’s Information with our trusted affiliates, vendors and any other third party, only to the limited extent and for purposes stated in this Policy, data analysis, storage, compliance with legal processes, prevention of fraud or imminent harm, ensuring the security of our network, sale of business. We reserve our right to disclose sensitive personal data or information to any government institution and authority where we are obligated by law for the purpose of verification of identity, or for prevention, detection, investigation, including cyber incidents, prosecution and punishment of offences, governmental requests, judicial decree or order, for enforcing and protecting our or others’ legal rights, for seeking any relief, defending any charge, opposing any claim or obtaining any legal advice.

4.7 We shall not publish the Users’ sensitive personal data or information. However, we shall not be responsible if the Users’ sensitive personal data or information becomes available on public domain by virtue of their own conduct or negligence.

5. How we secure your Information – security practices

5.1 We are committed to protect and maintain the privacy and confidentiality of the Users’ Information. For this purpose, LogicValley implements the international standard IS/ISO/IEC 27001 to ensure that our practices are compliant with the applicable law.

5.2 In addition to the above, our Service Platforms have put stringent measures necessary to detect, prevent and address misuse, unauthorised access, modification, disclosure or destruction of your Information. All Information gathered by us is stored on servers secured behind a firewall. Such servers are password-protected and access is strictly limited based on a need-to-know basis. The Service Platforms may use methods like de-identification, anonymisation and encryption by deleting or encrypting fields (such as name, e-mail addresses, contact numbers, etc) that identifies the User. Research and analytics may then be undertaken only on such anonymised data. However, we understand that as effective as our security measures are, no security system is impenetrable. Thus, we cannot guarantee the security of our database, nor can we guarantee that the Information you supply will not be intercepted while being transmitted to us over the Internet.

5.3 Our security systems are periodically audited to ensure that the integrity of your Information is intact. In case of any security breach which is likely to cause harm to the User, we shall notify the User as soon as practicable and take necessary remedial measures.

6. Use of cookies and other technologies

6.1 A Cookie is a small file which may be downloaded to and stored on your computer, mobile, tablet or other device while using our Service Platforms. It cannot read data off the User’s hard drive.

6.2 To make our Service Platforms work efficiently, we use cookies and other similar technologies to remember your registration and login details, preferences, detect the device used, meter the number of pages viewed for administering subscriptions to our newsletter etc. In addition, they enable us to provide Users with a personalised and seamless experience of our Service Platforms.

6.3 Advertisers who are advertising on our Service Platforms may also assign their own cookies from the User’s browser (if the User clicks on their ad banners), a process that we do not control and are in no way involved in. We may also place third party cookies on other websites to enable the serving of our own advertisements like subscription offers, etc. These advertisements will be based on your browsing behavior and will be tailored according to your interests. The data we gather from your visit shall be limited to page URLs.

6.4 We also use “essential cookies” which are necessary to provide a product or service that you may have requested. Essential cookies are used to deliver interactive services like web chat, maintain online security and protect against online fraud and record your preference regarding our use of cookies on your device. Without these cookies, we may not be able to provide some of our products or services. Even if you say “no” to the use of cookies, we may continue with their use.

7. Links to third party websites

The Service Platforms may provide links to third party websites. Any User who accesses or uses a third party’s website may be required to share their Information in order to avail its services. The User acknowledges and accepts that this Policy does not govern the collection, use, disclosure, processing and handling of a User’s Information by a third party website. LogicValley shall not be responsible for the hosted content as well as the data protection policies and practices of the linked websites. If any third party website is used to access or enter our Website, the User agrees to comply with the privacy policy, terms and conditions of such third party website and this Policy.

8. Retention of Information

A User’s Information may be retained and may continued to be used until: (i) the relevant purposes outlined in this Policy are no longer applicable; and (ii) we are no longer required by applicable law, rules, regulations, contractual obligations or legitimate business purposes to retain it and its retention is not required for the establishment, exercise or defense of any legal claim by us.

9. Correction, updation and erasure of information

As and when requested, Users may be permitted to review their Information. Users accept that they are responsible for the accuracy and completeness of their Information. We shall not be liable in case any Information is found to be inaccurate or deficient. It is advised that Users review, modify and update their Information as feasible. A User may also request the erasure of its Information and we shall take all necessary steps to erase it.

10. Anti-spam policy

10.1 We recognize the receipt, transmission or distribution of spam e-mails (unsolicited bulk e-mails) as a major concern and have taken reasonable measures to minimize the transmission and effects of spam e-mails in our computing environment. Accordingly, all e-mails received by us are subject to spam check. Any e-mail identified as spam will be rejected and deleted. With this measure, along with other technical spam reduction measures, we hope to minimize the spread and effects of spam e-mails. We reserve the right to reject and/or report any suspicious spam e-mails, to the concerned authorities and/or to the sender of such e-mails, for necessary action, from time to time.

10.2 Several deceptive e-mails, websites, blogs etc. claiming to be from or associated with us may be circulating on the Internet. These e-mails, websites, blogs etc. often include our logo, photos, links, content or other information. E-mails, websites, blogs etc. claiming to be associated with us may contact the User. The sources and contents of these e-mails, websites, blogs etc. and accompanying materials are in no way associated with us. For your own protection, we strongly recommend not responding to such e-mails or using these websites, blogs etc.

11. Disclaimer

We do not warrant that our Service Platforms, servers, or communications sent by us or on our behalf are virus free. We will not be liable for any damages of any kind arising from the above, including, but not limited to compensatory, direct, indirect, incidental, punitive, special and consequential damages, loss of data, goodwill, business opportunity, income or profit, loss of or damage to property and claims of third parties. It is advised that Users have licensed anti-virus software installed on their devices to protect them from malware.

12. Applicable law and jurisdiction

By visiting, accessing, browsing and/or using our Service Platforms, the User agrees to be bound by the laws of the Republic of India, without regard to its conflict of laws principles. Any dispute arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of courts in Coimbatore, Tamil Nadu.

13. Updation of Privacy Policy

LogicValley reserves its right to modify, alter, and update this Policy at any time, with or without prior notice. Although you shall be notified of material changes through your registered e-mail address or any other mode of communication, it is advised that you read this Policy regularly to be updated about any changes. If you continue to use or avail services of our Service Platforms after such modification, amendment, alteration or change, irrespective of whether notice was sent to you or published on the Service Platforms, you hereby are deemed to provide consent and accept this Policy and our other policies and practices existing at the time of visiting, accessing, browsing and/or using the Service Platforms.

14. Grievance Redressal Officer

We endeavour to address discrepancies and grievances of the Users with respect to the collection, use, storage, processing and handling of their Information in a time bound manner. Our aim is to resolve your issues within 30 days from date of receipt of your question, concern, grievance or report.
